Is your Section 21 notice valid?

A valid Section 21 needs more than a piece of paper. Answer these and we'll tell you whether the notice is enforceable — and which defects, if any, give you a defence.

What we check

  • • That the tenancy is actually an AST (Housing Act 1988)
  • • That your deposit was protected within 30 days and you got the prescribed information

  • • Notice on prescribed Form 6A
  • • The four-month and two-month timing rules under s.21 Housing Act 1988

Note: the Renters' Rights Act abolishes Section 21 once commenced. For now, defective notices are still the most common way tenants successfully defend possession claims.
